Terms of Use

These terms govern your use of the DailyThemes app for iPhone and iPad and the website dailythemes.app, provided by SahiTech Ltd ([TODO: registered country]). By downloading or using DailyThemes you agree to them. The app is also licensed to you under Apple's Standard Licensed Application End User License Agreement (the “Apple EULA”); if these terms conflict with the Apple EULA, these terms apply to the extent permitted.

1. Using DailyThemes

You may use the app and its content (wallpapers, live wallpapers, icons, widgets and themes) for personal, non-commercial purposes on devices you own or control. You may not resell, redistribute or publish the content as your own, use it in products for sale, or try to extract the catalog in bulk.

2. Your content

Photos and videos you use in the Maker stay yours and are processed on your device. You're responsible for having the rights to anything you import, including music and video.

3. DailyThemes Pro and auto-renewing subscriptions

DailyThemes is free to download. DailyThemes Pro is an optional auto-renewing subscription, offered monthly and yearly. Current prices are shown in the app before you buy and may vary by country.
Payment is charged to your Apple ID account at confirmation of purchase.
The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
A free trial may be available on the yearly plan. If you don't cancel at least 24 hours before the trial ends, the subscription starts and you are charged. Any unused part of a free trial is forfeited when you buy a subscription.
You can manage or cancel your subscription in Settings ▸ [your name] ▸ Subscriptions on your iPhone or iPad. Deleting the app doesn't cancel a subscription.
Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com.
If you reinstall the app or use a new device, tap Restore purchases in the app to restore Pro.

4. Free and time-limited content

Some content is free for a limited time, like the Daily Drop (free for 24 hours) and each day's door in The Season. Content you save while it's free stays in your Library. We may add, change or retire content in the catalog over time.

5. Apple and iOS

iOS doesn't allow apps to set wallpapers or change app icons directly. DailyThemes saves content to Photos and guides you through Apple's Settings and Shortcuts apps. Apple, iPhone, iPad, App Store, Shortcuts and Apple Health are trademarks of Apple Inc. Apple is not a party to these terms and isn't responsible for the app or its content.

6. Acceptable use

Don't misuse the app: no reverse engineering except where the law allows, no interfering with our services, and no using the app to break the law or infringe others' rights.

7. Intellectual property

The app, its design and the catalog content belong to SahiTech Ltd or its licensors. Fonts used in the app are licensed under the SIL Open Font License.

8. Disclaimers and liability

The app is provided “as is”. Widgets that show health, weather or calendar information are for convenience, not medical, safety or professional advice. To the extent permitted by law, we aren't liable for indirect or consequential losses, and our total liability is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law.

9. Privacy

Our privacy policy explains what data we process and why.

10. Changes and termination

We may update these terms; the date above shows the latest version, and we'll tell you in the app about significant changes. You can stop using the app at any time. We may suspend access if you seriously breach these terms.

11. Governing law

These terms are governed by the laws of [TODO: registered country], without affecting mandatory consumer protections where you live.
